Terms of Service

1. Agreement

By signing up for or using PowerOps, you agree to these terms. If you are signing up on behalf of a business, you represent that you have the authority to bind that business.

2. Subscription & billing

PowerOps is offered on monthly or annual subscriptions. Current plans: Core ($999/mo), Pro ($1,999/mo), Enterprise ($4,999/mo). All plans include unlimited users.

We offer a 14-day free trial with no credit card required. After the trial, your selected plan begins billing monthly or annually. You may cancel at any time from Settings » Billing; cancellation takes effect at the end of the current billing period.

3. Acceptable use

You agree not to:

  • Use PowerOps for unlawful purposes
  • Send unsolicited marketing communications that violate TCPA, CAN-SPAM, or A2P regulations
  • Reverse-engineer, decompile, or attempt to extract our source code
  • Use the platform to host, distribute, or transmit malware or phishing content
  • Attempt to breach another tenant's data or bypass our security controls
  • Resell or sub-license access without our written agreement

4. Your data

You own the data you put into PowerOps (customers, equipment, work orders, photos, etc.). We store and process it solely to operate the service for you, as described in our Privacy Policy. You may export your data at any time via Settings » Export or on request.

5. Availability & uptime

We target 99.9% monthly uptime for the platform. Scheduled maintenance will be announced at least 48 hours in advance. If uptime in any month falls below 99.5% due to our fault, you may request a prorated credit on the following month's invoice.

6. Warranties & disclaimers

POWEROPS IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED. NFPA 110 compliance tracking and AI-assisted diagnosis are tools — you remain solely responsible for regulatory compliance and technical judgment.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

8. Termination

You may cancel at any time. We may terminate or suspend your account for violation of these terms, non-payment, or fraudulent use. On termination, we will preserve your data for 30 days for export, then permanently delete it.

9. Governing law

These terms are governed by the laws of the State of South Carolina, USA.
